Eli Lilly Takes Legal Action Against Medical Spas, Clinics, and Compounding Pharmacies

In a statement released on September 19, 2023, pharmaceutical company Eli Lilly has announced that it has initiated legal proceedings against certain medical spas, wellness centers, and compounding pharmacies in the U.S. The company is attempting to stop entities from selling compounded products containing tirzepatide, the active ingredient in Eli Lilly’s medication Mounjaro. Tirzepatide has been on the Food and Drug Administration’s (FDA’s) Drug Shortages list for quite some time.  Despite Eli Lilly’s claim that these practices violate consumer protection laws, and could potentially lead to safety concerns, making compounded versions of commercially available drugs is permissible under special circumstances, like a shortage, according to the FDA. “When a drug is in shortage, compounders may be able to prepare a compounded version of that drug if they meet certain requirements of the Federal Food, Drug, and Cosmetic (FD&C) Act,” the FDA said.
