The FDA Pharmacy Compounding Advisory Committee’s recommendation to allow six peptides to be added to the Section 503A Bulks List has shifted attention to what comes next in the regulatory process. Although the committee voted in favor of broader access, the FDA is not required to adopt the recommendation or act within a specific timeframe. The decision now rests with the agency, as it weighs scientific findings, political pressure, and patient safety considerations.
In the WP Intelligence Health Brief, Edgar Asebey explained that it is unlikely the FDA will disregard its own scientists’ recommendations despite growing political pressure to expand peptide access. Edgar also noted that while HHS Secretary Robert F. Kennedy Jr. may have authority to place peptides on the bulks list, using that authority to accelerate access could face legal challenges because it was not intended to fast-track new substances.
