State legislatures across the country are becoming a new battleground in the ongoing debate over compounded medications, particularly GLP-1 weight loss and diabetes treatments. As concerns surrounding patient safety, ingredient sourcing, and regulatory oversight continue to grow, lawmakers in several states have introduced legislation that would impose stricter requirements on compounding pharmacies or further limit when compounded versions of commercially available drugs may be dispensed. Although many of these proposals stalled during the legislative process, lawmakers are expected to revisit the issue in future sessions.

In an article published in Bloomberg Law, Jesse Dresser discussed the growing legislative activity targeting compounded medications and the potential impact on compounding pharmacies. Dresser noted that many of the proposals closely track existing federal requirements governing when pharmacies may compound drugs that are commercially available.

“A lot of the legislation and regulation we’ve seen is just more restating FDA rules around making sure that pharmacies don’t make essentially copies of commercially available products.”
