Frier Levitt recently received an impressive $3.6 million arbitration award against Caremark and SilverScript on behalf of a specialty pharmacy client, Mission Wellness, arising from improper DIR Fees. Despite repressive “gag clauses” imposed by Pharmacy Benefit Managers (PBMs) on independent pharmacies that prevent providers and law firms from revealing victories against PBMs, the federal court refused to seal the case, resulting in the victory becoming public record through court filings.

“This isn’t unique to Mission Wellness. We invalidated Caremark’s DIR fees in entirety… Everyone’s afraid to tell the FTC what’s going on because of confidentiality clauses and gag clauses, but this is exactly what the FTC is asking about,” Levitt said.
