Edgar J. Asebey Featured in The Capitol Forum on Eli Lilly’s Retatrutide Classification Fight

Eli Lilly’s legal battle with the U.S. Food and Drug Administration (FDA) over the classification of its next-generation GLP-1 drug, retatrutide, could have significant implications for drug exclusivity, compounding pharmacies and future GLP-1 development, according to The Capitol Forum. Lilly is seeking to have retatrutide classified as a biologic rather than a small-molecule drug, which would provide a longer period of market exclusivity and restrict compounded versions. The case is before the U.S. Court of Appeals for the Seventh Circuit, where jurisdictional questions could result in the matter being sent back to the FDA for further review.

Edgar J. Asebey noted that the outcome could influence how pharmaceutical companies approach future GLP-1 development, particularly given the longer exclusivity available to biologics.

“This area of research will continue for many pharma companies, and they’re all going to shoot for 40 or more alpha amino acid sequences for these same rationales.”
