Steven L. Bennet, Esq. is a partner in Frier Levitt’s Life Sciences Litigation Practice Group. Steven offers comprehensive legal counsel to a diverse clientele, including various types of pharmacies such as specialty, home infusion, long-term care, dispensing physicians, and retail pharmacies. Steven also represents drug manufacturers, wholesalers, distributors, and reverse distributors in a diverse range of disputes.
A significant aspect of Steven’s practice involves navigating disputes with Pharmacy Benefits Managers (PBMs) on behalf of his clients. He adeptly assists his clients with complicated details of recovering direct and indirect remuneration (DIR) fees, challenging unreasonably low reimbursement rates, PBM network terminations, and PBM audits. Steven successfully helped his clients recover more than $100M in DIR fees and increased provider reimbursement rates from PBMs through strategic dispute resolution. Steven also defends clients in actions brought by regulatory bodies such as Boards of Pharmacy and Board of Medical Examiners as well as other governmental investigations.
Steven understands the unique needs of his healthcare provider clients: he helps them access special pharmacy networks, challenge unreasonable reimbursement terms, respond to new reimbursement models, and navigate an increasingly competitive market in one of the country’s most highly regulated industries. Clients regularly seek Steven’s advice and practical strategies aimed at minimizing litigation risk. He helps them craft better contracts and develop best practices for compliance with federal and state laws, from Stark Law and other anti-kickback rules to fraud, waste, and abuse regulations.
Prior to joining Frier Levitt, Steve served as a Deputy Attorney General for the State of New Jersey where he prosecuted cases for the New Jersey Office of Insurance Fraud Prosecutor related to healthcare claims fraud, white-collar insurance fraud, racketeering, and money laundering.
