340B Report recently featured Frier Levitt Attorney Geordan Ferguson in its article, “5th Hospital Sues CVS for Allegedly Diverting Millions in 340B Savings,” covering a growing series of lawsuits against CVS Health and its affiliates concerning alleged 340B reimbursement practices. Frier Levitt represents all five hospitals that have filed lawsuits to date, including Froedtert Memorial Lutheran Hospital, whose recently filed complaint alleges more than $18 million in damages and losses since 2020.
Discussing the broader potential impact of the alleged reimbursement practices beyond hospitals, Ferguson told 340B Report:
“The scheme does not discriminate. It affects grantees, it affects health centers. … Anybody with a CVS specialty pharmacy as a contract pharmacy is affected.”
Ferguson told 340B Report that Frier Levitt is “extremely confident” in its ability to overcome CVS’s motions to dismiss. He also noted that the alleged reimbursement practices may extend beyond hospitals to other 340B covered entities, including grantees and health centers.
