Fierce Healthcare Highlights Frier Levitt’s 340B Litigation Against CVS Health in Legal Battles Report

Fierce Healthcare examined some of the major legal battles currently shaping the healthcare industry, including disputes involving artificial intelligence, antitrust, drug pricing, and the federal 340B Drug Pricing Program.

Among the cases highlighted are lawsuits filed against CVS Health and its subsidiaries by major hospital systems represented by Frier Levitt. The hospitals allege that CVS improperly diverted more than $296 million in 340B savings intended to support care for low-income and underserved patients. According to the complaints, CVS affiliates manipulated specialty drug reimbursement processes to retain funds that should have been passed along to participating hospitals.

The litigation raises broader questions about transparency, accountability, and the protection of 340B savings intended to support safety-net providers. Jonathan Levitt emphasized the far-reaching financial implications of the alleged conduct, extending beyond the hospitals directly affected:
