Brian S. Kern, Esq. is of counsel for Frier Levitt’s Healthcare department. While attending Seton Hall Law School’s evening program, Brian worked as a medical professional liability (MPL) insurance producer in Somerville, NJ. Brian graduated a semester early in December of 2006 and was admitted to the New Jersey Bar in 2007. In January 2009, he and one of the principals of his insurance firm created a new professional liability insurance agency, Argent. After a series of successful M&A events, Brian is now a partner with an MPL brokerage, Acadia Professional, LLC, and the CEO of a value-based healthcare risk consulting firm called Deep Risk Management.
Brian is widely considered a national thought leader in healthcare risk and advises many of the largest and most sophisticated MSOs and medical practices on how to align financial and professional liability risk management strategies. His work has helped practices cut significant expenses, but also increase revenue by negotiating innovative reimbursement models – under both a fee for service and value-based care framework.
Working closely with leadership teams throughout the MPL industry, Brian has helped design new underwriting models to support emerging government and commercial payor-sponsored programs that include downside risk. Brian works with accountable care organizations and is a founding member of LAUNCH – a healthcare startup accelerator supported by FLAACOs. He works on shared savings and MLR arrangements, as well as episode of care programs. His work in these areas and ability to leverage unique data sources makes him a frequent presenter at national healthcare and MPL conferences.
Brian is admitted to the NJ State Bar Association and is a member of the American Health Lawyers Association (AHLA). He often speaks before health law and medical organizations, including state, county and specialty societies. He writes for publications throughout the healthcare industry, including MedScape (of WebMD) – where he served on the editorial advisory board, Medical Economics, and MD News.
Brian formerly sat on the advisory council for NJ Physicians, where he helped create the Medical Malpractice Defense Panel – a group of the top medical malpractice defense attorneys in NJ and was a member of its EHR committee. He is currently on the Board of NJ Healthcare Leaders Association, (NJHLA), where he serves as its Affiliate Chair, and a member of the Union County Medical Society Judiciary Committee. Brian has testified before the NJ Legislature and has worked on several bills impacting healthcare. In 2016, he was honored as one of “40 Under 40” by NJBIZ.
He also sits on the advisory board for SENA Health and the Advisory Council for the Health Alliance for Violence Intervention (HAVI), a non-profit devoted to preventing violence by providing community support services to victims presenting at emergency departments, particularly in underserved areas.
