Adino “A.J.” Barbarito, Esq. is an associate in Frier Levitt’s Life Sciences Litigation practice group. His practice focuses on representing independent pharmacies and pharmacy providers, including specialty, home infusion, long-term care, and retail pharmacies, as well as physician in-office dispensing practices, in complex litigation and pre-litigation in federal and state courts, and in arbitration.
A.J. represents providers in pharmacy benefit manager (PBM) contract and reimbursement disputes, audit disputes and network termination issues. He also assists infusion, hematology, and in-office dispensing providers with payment disputes with health plans, including out-of-network reimbursement disputes and medical and “J-Code” billing matters. In addition to his litigation practice, A.J. is actively involved in government affairs, drafting and editing proposed legislation, and advising elected representatives on PBM activity and related healthcare policy issues. He regularly files complaints with federal and state agencies, including the Centers for Medicare and Medicaid Services (CMS), the Federal Trade Commission (FTC), and the Department of Justice (DOJ) related to PBM misconduct.
Prior to joining the firm, A.J. represented municipalities and boards of education throughout New Jersey in public law matters, including labor & employment and education law. He previously served as a law clerk to the Honorable Amy O’Connor, J.A.D. of the Superior Court of New Jersey, Appellate Division in Morristown, NJ, and to the Honorable Christine Vanek, J.S.C., Superior Court of New Jersey, Law Division, Civil Part, in Jersey City, NJ. A.J. also brings valuable industry experience from his time as in-house litigation counsel at one of the nation’s largest 503A pharmacies and 503B outsourcing facilities, where he focused on trade secret and employment-related matters.
