Nicole M. DeWitt, Esq. is a senior counsel in Frier Levitt’s Healthcare Department who brings valuable dual experience from both the firm’s Litigation Practice Group and her previous career in the pharmaceutical industry to her current role.
Nicole provides strategic legal guidance to physicians, dentists, medical groups, pharmacies, and other healthcare licensees on regulatory compliance and contractual matters. She regularly advises clients on state and federal anti-kickback and self-referral laws, prohibitions against fee splitting and the corporate practice of medicine, and scope of practice issues. Nicole also assists clients in leveraging state freedom of information and the federal Freedom of Information Act (FOIA) requests to support strategic business objectives.
Nicole has significant experience in Medicare enrollment and revocation matters, including:
- Advising providers on initial enrollments, revalidations, and ongoing Medicare participation requirements.
- Successfully challenging Medicare contractors’ processing of applications through the formal rebuttal process.
- Representing Medicare suppliers in appeals of enrollment terminations.
- Securing rescissions of revocations for alleged noncompliance with supplier-specific enrollment requirements, and alleged abuse of billing privileges.
- Advocating for the removal of reenrollment bars ranging from one to ten years.
Nicole’s approach combines in-depth knowledge of Medicare requirements with a strong understanding of procedural rights, enabling her to help clients address issues that often impact Medicaid enrollments and result in retroactive revocation dates and claims recoupments for thousands of claims.
Before joining Frier Levitt, Nicole worked at a law firm handling healthcare provider reimbursement litigation. Her professional background also includes experience in the pharmaceutical industry, where she served as an Equipment Validation Scientist and Quality Assurance Supervisor for a drug manufacturer.
