Press Release – New York/New Jersey, April 26, 2023 – Frier Levitt is pleased to announce that Matthew Modafferi has joined the firm as a partner in the Litigation Team. Mr. Modafferi has practiced for more than 13 years and brings substantial federal civil trial experience. Mr. Modafferi has handled 24 federal court trials, 21 of which were jury trials, and has served as first chair in 19 trials. He previously served as Assistant United States Attorney, in the Civil Division at the U.S. Attorney’s Office for the Eastern District of New York (EDNY). Mr. Modafferi will focus his practice on white collar defense and investigations, and complex civil litigation.
Mr. Modafferi represented the United States of America and its various agencies in affirmative and defensive matters in the EDNY and the Second Circuit Court of Appeals. He defended against challenges to Executive Branch policies and initiatives and prosecuted health care fraud qui tam and other False Claims Act matters. Mr. Modafferi handled the government’s case, along with a team of attorneys, against Barclays Bank and its affiliates related to Barclays’ underwriting and issuance of residential mortgage-backed securities, which resulted in a multi-billion dollar settlement.

In addition to his legal experience, Mr. Modafferi serves as an Adjunct Professor at Brooklyn Law School, where he teaches litigation skills and learning from practice.
Mr. Modafferi earned his J.D. from Brooklyn Law School his B.A. from Boston College, cum laude.
