How Pharmacies Can Take Action Against GER Deductions Regardless of Amount

Epic Pharmacy Network, Inc. (Epic) has sent demands to network pharmacies notifying its members that it will withhold future payments because of a Generic Effective Rate (GER) adjustment. These notices are being sent to network pharmacies regardless of size, and in amounts as large as more than $5 Million, but sometimes in amounts less than $20,000. Depending on the size of a pharmacy, $20,000 withheld from a pharmacy can be as devastating to a pharmacy as having $5 Million withheld from a large pharmacy.

Frier Levitt is actively seeking pharmacies who have received similar letters from Epic or any other Pharmacy Service Administrative Organizations (PSAOs) demanding GER deductions for the purposes of putting together a collective action against these PSAOs to demand reimbursement of any and all withheld funds and to prohibit these types of predatory actions in the future. This call to the industry seeks out even those pharmacies that believe their PSAO withholding is a relatively small sum of money.

Frier Levitt has extensive experience representing pharmacies in challenging GER adjudication. If your pharmacy has received a letter from any PSAO notifying the pharmacy that it is withholding funds, contact Frier Levitt today to speak to an attorney.
