ATTENTION NUTMEG BENEFIT TRUST INVESTORS

Have you or your company been damaged by unauthorized withdrawals or loans against life insurance policies in which you are the insured?

It has recently been discovered that Michael Millman, Trustee of the Nutmeg Benefit Trust and Nutmeg Benefit Group, LLC, may have made withdrawals or loans from life insurance policies of the Trust. The purpose of the loans is presently unknown. However, as a result of the withdrawals or loans, the beneficiaries of the Trust may have been substantially damaged. These damages include loss of your investment and potential tax consequences.

The Trustees of Nutmeg Benefit Trust owed a fiduciary duty to the beneficiaries of the Trust to act in their best interest. A person who violates the fiduciary duty may be liable to the beneficiaries for all damages naturally flowing as a consequence of the wrongful acts.

Damages include the loss of the investment, possible tax liability incurred by the beneficiaries that would not have otherwise been owed but for the unauthorized withdrawal or loan, penalties and interest on the taxes. In certain situations the Court may award “treble” (triple) damages and attorneys’ fees.

If you believe you have had unauthorized withdrawals or loans taken from your life insurance policy, please contact Frier & Levitt, LLC for a free initial consultation. Depending on the size of your loss, we may be willing to handle your claim on a contingency fee.
