We concentrate on litigation avoidance, but provide litigation support in these areas to resolve existing issues.
Types of Labor and Employment cases we handle:
- Wrongful Termination;
- Violations of the NJ Law Against Discrimination, NJ Family Leave Act, and Federal Family and Medical Leave Act;
- Whistleblower Actions ("CEPA" cases);
- Restrictive covenant litigation;
- ERISA and employment benefits litigation; and
- Other employment related issues and disputes.
Employment Law: Employers require assistance in every aspect of their relationship with the work force. Employers seek our advice in work force restructuring, employee terminations and discipline. When employees seek leaves of absence, we provide advice on compliance with the Federal and State Family and Medical Leave Acts, the Americans with Disabilities Act and the New Jersey Law Against Discrimination, COBRA and Workers’ Compensation laws. We assist clients in investigation of alleged employee misconduct involving harassment, discrimination, and drug use. We draft employment documents including employee manuals, employment and consulting agreements, severance agreements, confidentiality agreements and non-compete agreements. We also review and provide advice on employee agreements containing stock options.
Discrimination Litigation: Frier Levitt,
LLC represents employers and employees in litigation involving
claims of discrimination of the basis of age, sex, race, national
origin, religion and disability, as well as claims of sexual and
racial discrimination.
ERISA and Employee Benefits Litigation: The
Employee Retirement Income Security Act ("ERISA")
is a federal law that governs employee retirement, deferred
compensation and welfare benefit plans. We are experienced
in representing both employers and employees in ERISA matters.
