Recently, we obtained a very favorable settlement on behalf of thousands of retail compounding pharmacies across the United States against one of the nation’s largest Pharmacy Benefits Manager (PBM), as a result of the PBM’s abusive audit practices. 

In addition, we are in the process of performing due diligence as we prepare to pursue a class action against another major PBM based on the PBM’s improper use and sharing of claims data with its retail and mail order pharmacies.  The PBM uses this confidential claims data obtained from its provider pharmacies at the point-of-sale to solicit and divert patients away from the provider pharmacies with whom it has a contract, and towards the PBM’s retail and mail order pharmacies.  

Not surprisingly, the PBM does not reveal to its provider pharmacies that it is engaging in this improper conduct.
