About John C. Warley
Of Counsel
John C. Warley is an experienced litigator who has successfully represented pharmacies throughout the United States in disputes with PBMs. Most recently, he served as co-counsel to a class of pharmacies in litigation against a major PBM.
In 2005, he represented Plum Creek Pharmacy of Amarillo, Texas, in AAA arbitration challenging audits conducted by AdvancePCS (subsequently acquired by Caremark Rx, the named respondent). Plum Creek challenged AdvancePCS's audit retractions following on-line adjudication of compounded prescriptions. A Dallas arbitrator found in favor ofPlum Creek, awarding damages, attorneys' fees, costs and expenses. In Re Plum Creek Pharmaceuticals v. Caremark Rx, Inc. 71 181 00082 05.
Prior to establishing The Law Office ofJohn C. Warley in Fredericksburg, Virginia, Mr. Warley was a member ofthe Richmond, Virginia law firm DurretteBradshaw, where he served in the healthcare practice group. Among the pharmacy-related matters handled by the firm and Mr. Warley were In Re Brand Name Prescription Drugs, In Re Ciprofloxin Hydrochloride and Vitamin Product Antitrust Litigation.
Mr. Warley has a B.A. from The Citadel (1967) and took his J.D. from the University of Virginia School ofLaw (1970). From 1971 to 1973 he served as staff counsel to the Cosmetics, Toiletries and Fragrance Association in Washington, D.C. He is a former Assistant Commonwealth Attorney for the city of Newport News, Virginia, chairman of the Board ofthe Newport News Redevelopment and Housing Authority, and a member ofthe board ofthe Virginia Housing Development Authority.
